Terms & Conditions

Review the terms governing the use of the Call Camp AI platform, voice APIs, and campaign management services.

Effective Date: June 20, 2025

These Platform Terms of Service ("Terms") govern access to and use of the Call Camp AI voice agent automation platform, associated API endpoints, and campaign suites (collectively, the "Platform") for clients situated outside of the United Kingdom, Switzerland, and the European Economic Area. For customers inside those regions, please consult our EEA Terms of Service.

1. User Accounts and Platform Access

1.1 Account Setup. Customers must register an account, maintaining precise account details and safeguarding access credentials from disclosure.

1.2 Eligibility Requirements. Access is permitted solely for business purposes by registered commercial entities or authorized individuals aged 18 years or older.

1.3 Account Responsibility. The Customer assumes full liability for all actions, transactions, and API requests executed under their account credentials.

2. Definition of Terms

Customer Data: All uploaded contact lists, dial scripts, CRM records, and business parameters imported into the Platform by the Customer.

Outputs: Transcripts, audio recordings, analytics reports, customized agent configurations, and telemetry logs generated by the Platform.

Sub‑processors: External service partners engaged by Call Camp AI to assist in delivering platform infrastructure and voice routing.

3. Intellectual Property Rights & Improvements

3.1 Data Ownership. The Customer retains proprietary rights over Customer Data and resulting Outputs, subject to third-party integrations and these Terms.

3.2 Platform IP. Call Camp AI retains all right, title, and interest in the Platform, including underlying proprietary algorithms, software stacks, UI layouts, and trade secrets.

3.3 Performance Optimizations. We utilize anonymized, aggregated usage telemetry to optimize platform safety and call performance. An Enterprise No‑Train Addendum is available upon request to disable telemetry training for private stacks.

4. Usage License & Prohibitions

4.1 Granted License. Call Camp AI grants the Customer a non-transferable, non-exclusive, revocable license to access the Platform for internal commercial operations, subject to compliance with these Terms and the Acceptable Use Policy (AUP) below.

4.2 Restrictions. Customers agree not to: reverse-compile the software; bypass rate limits; publish competitive benchmarks; re-identify de-identified metrics; or use any Platform outputs to develop competing machine learning models.

5. Billing, Pricing, and Suspension

5.1 Platform Fees. Payment is due according to the selected online plan or executed order form. All fees exclude taxes, carrier termination rates, and overages (such as voice minutes, messaging volume, and database storage).

5.2 Billing Cycles. Payment methods may be pre-authorized. Disputed invoices must be submitted in writing within 15 calendar days from the invoice date.

5.3 Service Suspension. We reserve the right to restrict account access for unpaid balances, material breaches of the AUP, security vulnerabilities, or regulatory mandates.

6. Telephony and Campaign Compliance

6.1 Compliance Obligations. The Customer is responsible for adhering to all local consumer protection, outbound dialing, and call recording laws where call recipients reside, including UAE Cabinet Resolution No. 56 of 2024 (Telemarketing Regulations), Cabinet Resolution No. 57 of 2024 (Administrative Penalties), and Do‑Not‑Call Registry (DNCR) requirements.

6.2 Global Call Standards. When placing calls internationally, the Customer must follow respective local regulations, such as the US TCPA/TSR standards, ePrivacy regulations in the EU, two-party consent laws, and local mobile carrier frameworks.

6.3 Anti-Circumvention. The Customer must use the opt-out features, suppression lists, and DNC scrubbing tools built into the Platform and agrees not to bypass these safety structures.

6.4 Telecommunications Disclaimer. Call Camp AI is a software provider, not a utility telecommunications carrier. Line termination, caller ID presentation, and voice routing rely on global carrier partners and are subject to change.

7. Data Privacy and Governance (UAE PDPL)

7.1 Role Designations. Unless a custom Data Processing Addendum (DPA) is signed, Call Camp AI acts as Processor and the Customer acts as Controller under the UAE Federal Decree-Law No. 45 of 2021 on Personal Data Protection (PDPL).

7.2 DPA Incorporation. The standard Data Processing Addendum is incorporated by reference in Section 3 of our legal directory.

7.3 Cross-Border Data Flows. International transfers rely on legal security frameworks, including standard contractual clauses (SCCs) and appropriate transfer safeguards.

7.4 Sensitive Content. Processing biometric data, voiceprints, or health categories requires the Customer to establish a lawful basis, maintain appropriate policy documentation, and perform a Data Protection Impact Assessment (DPIA).

8. Security Protocols and Confidentiality

Both parties agree to implement industry-standard technical measures to protect confidential trade data. Proprietary information may only be disclosed as necessary to provide or consume the Platform services.

9. Platform Modification and Service Levels

9.1 Uptime Target. We aim for a monthly uptime percentage of 99.9%, with service credits provided according to our SLA if target limits are missed.

9.2 Feature Adjustments. We may update features and voice APIs. Deprecations that reduce core features will receive 30 days' advance notice when practicable.

10. Indemnification Terms

10.1 Customer Indemnity. The Customer will defend, indemnify, and hold harmless Call Camp AI from and against third-party claims arising from Customer Data, Outputs, campaign activities, or breaches of the AUP or local laws.

10.2 Call Camp AI Indemnity. Call Camp AI will defend and indemnify the Customer against direct claims that the Platform infringes third-party intellectual property, excluding claims resulting from customer code combinations or modifications.

11. Artificial Intelligence Disclaimers

Voice agents operate using probabilistic machine learning. Outputs may contain mistakes, inaccuracies, or incomplete statements. The Customer is responsible for verifying outputs before using them for commercial decisions.

12. Limitation of Liability

Except for billing obligations, intellectual property indemnities, and data protection breaches: either party's maximum aggregate liability in any 12-month period is capped at the fees paid by the Customer in that same period; indirect or consequential damages are excluded.

13. Subscription Term and Termination

Subscriptions renew automatically unless terminated per your plan rules. Either party may terminate for material breach if it remains uncured 30 days after notice. Customer Data and Outputs remain exportable for 30 days after termination, prior to removal.

14. Commercial Publicity

Call Camp AI may feature the Customer's name and brand logo in public customer registries and marketing materials unless opted out in writing.

15. Governing Law and Arbitration

15.1 Governing Law. These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates.

15.2 Dispute Resolution. Disputes will be resolved through binding arbitration in Dubai, UAE under the Dubai International Arbitration Centre (DIAC) Arbitration Rules, in English, by one arbitrator (or three for claims exceeding USD 1,000,000). Injunctive or emergency relief may be sought before the Courts of Dubai.

16. Order of Precedence

In case of conflict, the priority order is: Order Form → Platform Terms → AUP → Telemarketing Addendum. These documents constitute the entire agreement between the parties.


Acceptable Use Policy (AUP)

The Customer and all authorized users agree not to use the Call Camp AI Platform to:

  • Engage in illegal activities, rights infringement, or distribute defamatory, harassing, or intrusive recordings.
  • Circumvent telemarketing regulations, caller ID obligations, local DNCR registries, or time-of-day limits.
  • Deliver spoofing, phishing, impersonation, credential harvesting, or payments fraud.
  • Conduct unauthorized political campaigns, emergency broadcast calls, or target vulnerable groups.
  • Extract or process biometric templates and voice profiles without explicit consent.
  • Scrape data indexes, bypass unsubscribe headers, or re-identify telemetry.
  • Launch vulnerability tests, load testing, or exploit security parameters without permission.
  • Use outputs to benchmark performance for competitor marketing or to train competing models.
  • Implement features in high-risk environments where failure may lead to physical injury or property damage.

Outbound Calling & Telemarketing Addendum

This Addendum governs all outbound campaigns directed into or originating from the UAE.

A. Regulatory Approvals & Compliance

A.1 You will obtain and maintain all required telemarketing permits from UAE authorities.

A.2 You must maintain logs and train employees on Do‑Not‑Call requirements and opt-out handling.

B. Do‑Not‑Call Registry (DNCR)

B.1 Scrub all numbers against the UAE DNCR index prior to running dial campaigns.

B.2 Honor verbal and keypress opt-outs immediately, updating suppression databases.

B.3 Do not call numbers registered on the UAE DNCR unless explicit legal exemptions apply.

C. Call Timing and Caller ID Presentation

C.1 Present a verified caller identity traceable to your legal entity.

C.2 Comply with UAE telemarketing frequency rules and time-of-day constraints.

C.3 Do not rotate caller IDs to bypass blocklists or spoof identities.

D. Consent and Recording Rules

D.1 Obtain and record lawful consent for recordings and analytics.

D.2 Obtain consent from all participants before recording in jurisdictions that mandate multi-party consent.

E. Regulatory Penalties

E.1 You acknowledge that violations of telemarketing laws are subject to administrative fines and penalties under UAE Cabinet Resolution No. 57 of 2024.
